Battle lines have been drawn against New York State and the borders are clearly defined by sovereign land.
The Seneca Nation of Indians have vowed to fight the Governor and Legislatures who are using “emergency” procedures to circumvent proper procedures under Federal law in order to fill holes in the budget. On Monday a Supreme Court Judge ruled to overturn an injunction that was preventing the state from imposing a tax on the tribe’s cigarette sales, which is suppose to go in effect tomorrow.
The tribe is arguing that such a tax infringes on the tribes sovereignty and are seeking a restraining order and all legal means necessary to overturn the Legislation.
Not only are they refusing to pay the tax they also said they have voted to stop all future casino payments to the state, estimated at $64 million a year.
Tribal officials said that they would no longer pay exclusivity payments as agreed to under the 2001 gaming compact, claiming that state approved operations including Batavia Downs Casino and Finger Lakes Gaming and Racetrack violate the terms of the compact.
