The Harmon Tower at the center of the Las Vegas CityCenter and the center of a legal battle between owner MGM Resorts International and Perini Building Co. has been ordered by the Clark County District Court Judge to be inspected.
Despite MGM’s objections to allow Perini back on the site, the judge ruled that Perini has the right to inspect damages that MGM alleges Perini made during construction of the 27 story hotel tower.
“Perini has no contractual right to repair,” MGM Resorts spokesman Alan Feldman said. “Perini has failed or refused to timely correct or repair the defective work within the acceptable time frame despite having knowledge of the defects. Perini’s defective work is a noncurable default under the construction agreement.”
In March MGM escorted Perini employees and sub-contractors from the property and withheld $450 million worth of payments, which prompted the lawsuit.
“Once this goes away, they have no argument,” Perini President and CEO Craig Shaw said “This was basically contrived by them as a reason to hold all of our money and not allow us to fix the building. We have a right to fix any defective work.”
“Hopefully, the judge will allow us to make the corrections so the building can be used for its intended purpose as a hotel.” Shaw added.
